supply of goods and services?

hi

i was sold a cctv system for my private home by the market leader in such products and I parted with part payment (£5565) with balance for the sum of £7500+ VAT on completion. The specification was designed and proposed by the supplier.

In Feb 09, the neighbour called the local council with regards to the equipment installed ( 2 x dome cameras on a 6 metre pole and 1 x static Infra Red camera on a 3 m pole) in the garden within our property.

As the council did not get back to me swiftly and the contractor was pushing to complete the works, I had allowed the contractor to finish the install as he was adamant no permission was required.

Planning was submitted and in Nov 09, it was rejected and I wrote a letter to contractor to remedy the problem with a solution that will be acceptable to the local council. Things are about to turn legal and the supplier is not accepting liability for the advice that was given at the time when the issue had arisen.

Advice as to the legal position will be appreciated as the supplier is not accepting responsibility. I have told them to collect it if they can not fix the problem with respect to the installation conflicting with local and national legislation.

    This question is beyond the scope of photographic camera advice and treads into legal matters that need to be addressed to a solicitor, not a group of photographers.

    I think there is no avoiding paying a lawyer for advice on this. My guess is that an issue is going to be whether the company was truthful or not in its alleged claim that they installed similar systems without facing any need to get planning permission. That might require some kind of court order to get the appropriate records.
